At Toku, every agreement we send to your employees and contractors is built from templates our legal team has already reviewed, approved, and vetted for each country. These templates are designed to meet local labor law and protect both your company and your team. If you would like changes made to any of these agreements, a custom agreement change fee of $49 USD applies. This article explains how that fee works and what to expect.
๐ What Is a Custom Agreement Change?
A custom agreement change is any edit you request to Toku's standard, pre-approved agreements. This applies to every agreement Toku sends to an employee or contractor, including:
- EOR employment agreements
- Contractor and consulting agreements
- PEO agreements
- Any other agreement Toku sends to your workers for signature Common examples include changes to notice or probation periods, termination or severance language, benefits or compensation terms, confidentiality, IP, or non-compete clauses, or adding your own company-specific language.
Note: Standard details you enter in the Toku platform when onboarding, such as name, job title, salary, and start date, are not custom changes. These are filled in automatically and do not carry a fee.
๐ฐ Custom Agreement Change Fee
- Fee: $49 USD per custom agreement version
- Why it applies: Any change to an approved template must be rechecked by our legal team before it can be used, to make sure it still complies with local law.
- Manual handling: The Toku platform sends our standard agreements automatically during onboarding. When you use a custom version, our team steps in manually to make sure your worker receives the correct custom agreement instead of the standard one.
๐ One-Time Fee vs. Per-Hire Fee
How often you are charged depends on how you use your custom agreement.
One custom template, reused for everyone in a country
If you want one set of changes to a country's template and then use that same custom version for all of your employees in that country going forward, you pay a one-time $49 USD fee. Every future hire in that country receives the approved custom version at no extra cost, as long as the agreement does not change.
Different custom changes for each hire
If you request different changes each time you onboard someone, each version needs its own legal review. The $49 USD fee applies every time.
| Scenario | Fee | How Often |
|---|---|---|
| One custom template per country, reused for all future hires | $49 USD | One time per template |
| Different custom changes for each new hire | $49 USD | Every time |
| New changes to a custom template you already have | $49 USD | Each time the template is updated |
Note: Custom templates are set up per country. If you want custom versions in more than one country, each country's template is a separate $49 USD fee.
โ๏ธ What Our Legal Review Covers
Our legal team checks every requested change against local labor law in the worker's country. Some changes cannot be made, even if you are comfortable with the risk. For example, many countries set minimum notice periods or probation limits that cannot be shortened by agreement.
- If a change is not permitted under local law, we will let you know and suggest a compliant alternative where possible.
- If a change is permitted but shifts legal risk, we may ask you to sign a short indemnification agreement confirming you understand and accept that risk before the custom agreement is used.
๐๏ธ How to Request a Custom Agreement Change
โ ๏ธ Submit your request before you onboard the worker in the Toku platform. Because agreements are sent automatically, a worker onboarded before your custom version is approved will receive our standard agreement.
- Email customer-success@toku.com with:
- The country and agreement type (employment, contractor, or PEO)
- The changes you would like made
- Whether this is a template for all future hires in that country, or for one specific hire
- Allow at least 3 business days for legal review from the time we receive your complete request.
- Once approved, we confirm with you and make sure the custom version is the agreement your worker receives.
๐งพ Where Will I See This Charge?
The custom agreement change fee is added to your next Toku invoice, sent from billing@toku.com. If you have questions about a specific charge on your invoice, please reach out to that address directly.
โ FAQs
If I set up one custom template for a country, am I charged for every new hire?
No. A custom template reused for all future hires in that country is a one-time $49 USD fee. You are only charged again if you request new changes to it.
What if each of my new hires needs slightly different terms?
Each different version needs its own legal review, so the $49 USD fee applies each time. If your changes tend to be the same, we recommend setting up one custom template per country to avoid repeat fees.
Does this apply to contractor and PEO agreements too?
Yes. The fee applies to changes to any agreement Toku sends to an employee or contractor, including EOR employment, contractor and consulting, and PEO agreements.
Can I make changes to the agreement myself in the platform?
No. Agreement wording can only be changed by Toku after legal review. Please send your request to customer-success@toku.com.
What happens if a change is not allowed under local law?
We will let you know and, where possible, suggest a compliant alternative. Toku cannot use agreement terms that do not meet local legal requirements.
